Who this is for
Solo attorneys, small firms, in-house counsel billing affiliated entities, paralegal services, and legal consultants. Anyone billing for hourly legal work where partner, associate, and paralegal rates differ.
What makes a legal invoice distinctive
1. Matter / file reference. Every line ties back to a specific case. Including the matter number on every invoice (and ideally each line) is non-negotiable for corporate clients whose in-house counsel needs to allocate expenses.
2. Role-based rates. Same task, different rate depending on who did it. Partner time at one rate, associate at another, paralegal at a third. The invoice line should make the role explicit: Partner — drafting cross-motion — 2.5 hrs @ $450.
3. Trust account drawdown. If the client has a retainer in trust, show the drawdown as a negative line and the remaining trust balance in the notes. This is a state-bar requirement in many jurisdictions, not just a courtesy.
Pitfalls that get attorneys in trouble
- Mixing trust and operating funds. The classic fee-dispute and bar-complaint trigger. Trust drawdown happens after the invoice is delivered and the client has had an opportunity to dispute — not before.
- Block billing. "Misc. case work — 8 hrs" gets reduced or rejected by corporate AP and many insurers. Itemize.
- Missing the time entry detail. Some clients require the underlying time-entry log attached. Keep it ready — don't embed it in the invoice itself, but offer it.
- No interest clause. A standard 1.5% per month on overdue balances clause is enforceable when the engagement letter authorizes it. Use it.
Payment terms in legal services
Net 30 is the standard for both corporate and individual clients. For long-running matters, monthly invoicing is the norm. For litigation involving expert witnesses or court filings, consider advance fund requests separately from the regular invoice.
For contingency-fee matters, this template is the wrong tool — issue a fee statement at resolution rather than time-based invoices.
